TERMS & CONDITIONS

Hautology Watches Ltd.

Last updated: [15/07/2026]

Welcome to Hautology Watches. These Terms & Conditions (“Terms”) govern your relationship with Hautology Watches Ltd. (“we”, “us”, “our”) whenever you buy from us, sell to us, consign a watch with us, use our servicing or repair services, or browse our website.

Please read these Terms carefully before transacting with us or using our website. By doing so, you confirm that you have read, understood, and agreed to them. If you do not agree, please do not use our services.

These Terms should be read alongside our Privacy Policy, our Returns & Warranty Policy, our AML/KYC Policy, and any specific agreement you enter into with us (such as a Consignment Agreement, Watch Purchase Agreement, Prospective Watch Purchase Agreement, or Sales Agreement & Invoice), all of which form part of the overall terms of your relationship with us. Where there is any conflict between these Terms and a specific signed agreement, the signed agreement prevails.

1. Who We Are

Hautology Watches Ltd. is a pre-owned luxury watch business registered in Ireland, with our principal place of business at 5 Gardiner Row, Dublin 1, D01 R3K1. We buy, sell, and consign pre-owned luxury watches, and provide watch servicing and repair services. We also sell related accessories including watch straps, watch rolls, watch stands, and other items.

These Terms apply to all of the above activities, whether conducted in person at our premises, online through our website, or by any other means of communication.

2. Our Services

2.1 Selling Watches & Accessories to You

We sell pre-owned watches and accessories both in person and online. Every item we sell is described as accurately as possible. As all items are pre-owned, they may show signs of age and wear consistent with their stated condition. We warrant that every watch we sell is authentic, that we hold free and clear title to it, and that it is as described at the time of sale.

All sales are subject to our Returns & Warranty Policy, which is incorporated into these Terms by reference. Please read it before purchasing.

2.2 Buying Watches From You

We purchase pre-owned watches directly from individuals, whether in person or remotely. For in-person purchases, the terms are set out in our Watch Purchase Agreement, signed once the watch has been physically inspected and a price agreed. For watches submitted to us remotely before a price is agreed, our Prospective Watch Purchase Agreement applies instead, setting out the inspection and offer process. Payment is made exclusively by direct bank transfer — we do not pay by cash or cheque under any circumstances.

Any price offered is conditional on the watch being in the condition and accompanied by the items described at the time of the offer. We reserve the right to revise or withdraw an offer upon physical inspection if the watch differs materially from its description.

2.3 Consignment

We accept watches on consignment, acting as your agent to market and sell the watch on your behalf. Consignment arrangements are governed in full by our Consignment Agreement, which must be signed before a watch is accepted. Key terms include an agreed minimum payout, a 366-day consignment period, and commission of 10% plus VAT on the sale price.

2.4 Servicing & Repair

We offer watch servicing and repair carried out by our watchmaker. All service work carries a one-year mechanical warranty from the date the watch is returned to you, covering faults arising from the work carried out. This warranty does not cover physical damage, water damage, or any fault unrelated to the service work performed.

We will always communicate an estimated cost and timeline before work begins and will seek your approval before proceeding.

3. Pricing

3.1 General

All prices displayed on our website or communicated to you are in euros (€) unless otherwise stated. We reserve the right to change prices at any time without notice. The price applicable to your transaction is the price agreed at the time of sale.

3.2 VAT

We operate under the VAT Margin Scheme for second-hand goods, as permitted under EU VAT Directive 2006/112/EC and Irish VAT legislation. Under this scheme, VAT is calculated on our margin rather than the full sale price and is not separately itemised on invoices to customers. The price you see is the price you pay.

Our commission on consignment sales is subject to VAT at the standard Irish rate (currently 23%), which is applied to the commission amount only and is detailed in the Consignment Agreement.

3.3 Card Payments

No surcharge is applied for paying by credit or debit card: surcharging consumer card payments is prohibited under the Payment Services Regulations 2018 (transposing PSD2), and we do not apply one. Direct bank transfer remains available as an alternative payment method.

3.4 Pricing Errors

We take care to ensure all prices on our website are accurate. However, errors may occasionally occur. If we discover a pricing error after you have placed an order, we will contact you as soon as possible to let you know. You will have the option to proceed at the correct price or cancel your order for a full refund. We are not obliged to honour a price that is clearly erroneous.

3.5 Availability

All watches listed for sale are one-of-a-kind items. In the event that a watch sells before your order is processed — for example, where a watch is purchased in person while also listed online — we will notify you promptly and issue a full refund. We will do our best to minimise any such occurrence but cannot guarantee availability until a sale is confirmed.

4. Payment

We accept the following methods of payment for purchases from us:

  • Direct bank transfer in euros (no surcharge)

  • Credit or debit card, online or in person (no surcharge)

We do not accept cash or cheques for any transaction, whether buying from us, selling to us, or consigning with us.

Payment for online purchases must be made in full before an order is dispatched. For in-person purchases, payment is required at the point of sale.

Where we are making payment to you — for example, following a watch sale or consignment payout — payment will be made by direct bank transfer only to an account you confirm you are authorised to receive funds into. We will not transfer funds to an unrelated third party without a written explanation and our express approval.

5. Orders & Contract Formation

When you place an order with us online, you are making an offer to purchase. A contract between us is only formed when we confirm your order in writing (by email or otherwise) and, where applicable, when payment has been received.

We reserve the right to decline any order at our discretion — for example, where an item is no longer available, where a pricing error has occurred, or where we are unable to verify your identity or payment.

For in-person transactions, the contract is formed at the point of sale when payment is made and accepted.

6. Returns & Warranty

Our full returns and warranty terms are set out in our Returns & Warranty Policy, which is available on our website and incorporated into these Terms by reference. The key points are summarised here for convenience:

  • Online purchases: 14-day right of return from the date of confirmed delivery, in accordance with the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.

  • In-person purchases: 3-day change-of-mind period from the date of purchase.

  • For online purchases, your right to cancel is not conditional on the item being returned in its original, unhandled condition. Where an item shows handling beyond what is reasonably necessary, or is missing an accompanying item such as box, papers, or an integral part, we will deduct a substantial amount from your refund reflecting the reduced value; we will not refuse a valid cancellation made within the 14-day period on that basis alone. For in-person purchases, all accompanying items must be returned within the 3-day change-of-mind period, and we reserve the right to refuse a return or retain part of the refund where an item is missing, as this period is a discretionary goodwill policy rather than a statutory right.

  • Watches sold by us carry a one-year mechanical warranty from the date of receipt, covering internal mechanical faults under normal use. This warranty does not cover physical damage, water damage, or damage caused by misuse or unauthorised modification.

  • All service work carries a one-year mechanical warranty from the date the watch is returned to you.

  • Accessories (straps, watch rolls, stands, etc.) are not covered by a mechanical warranty but are subject to the applicable cooling-off period.

To initiate a return or warranty claim, please contact us by email or via the contact form on our website.

7. Delivery & Shipping

All items dispatched by us are fully insured for their sale value during transit. We bear reasonable risk as the shipper from the point of dispatch until confirmed delivery by the courier.

You must make all reasonable efforts to receive your delivery. Once a parcel is marked as delivered by the courier, our transit liability ends. We are not responsible for items that go missing or are damaged after confirmed delivery.

Where an item is lost or damaged in transit, we will pursue an insurance claim promptly and in good faith. Any refund or replacement will be arranged once the claim is resolved. Where a card payment is involved, we ask that you allow the insurance process to conclude before raising a chargeback.

Delivery timeframes provided are estimates only. We will do our best to meet them but do not guarantee delivery by a specific date and are not liable for delays caused by couriers or other circumstances outside our control.

8. Selling & Consigning With Us

8.1 Ownership Warranties

Whether you are selling a watch to us outright or consigning it with us, you warrant that:

  • You are the legal owner of the watch and have full authority to sell or consign it;

  • The watch is free from any finance agreement, hire purchase, encumbrance, or third-party claim;

  • The watch has not been reported as lost or stolen to any insurer, police authority, or watch registry;

  • All information you provide about the watch is accurate and complete to the best of your knowledge.

If any of these warranties are found to be false, you will be liable to reimburse us in full and to indemnify us against any loss, cost, or liability arising as a result.

8.2 AML & Identity Verification

We are required by the Criminal Justice (Money Laundering and Terrorist Financing) Acts 2010–2021 to verify the identity of individuals who sell, consign, or purchase watches with us — including buyers, particularly for cash transactions of €10,000 or more. You will be asked to provide valid photographic ID (passport, national identity card, or driver’s licence) and proof of address where this applies. Further detail is set out in our AML/KYC Policy.

We reserve the right to refuse a transaction if we cannot complete satisfactory identity checks, and to report suspicious activity to the relevant authorities — including the Garda Síochána and the Revenue Commissioners — as required by law.

8.3 Condition & Description

For outright purchases, the price offered is conditional on the watch matching the description provided. For consignments, the agreed minimum payout is based on the watch as described. In both cases, we reserve the right to revise or withdraw our offer upon physical inspection if the watch or its accompanying items differ materially from the description. This does not apply where the watch is instead found to be counterfeit, stolen, or otherwise unlawful for us to deal in — in that circumstance, we will not revise our offer, complete the transaction, or return the watch, and the matter is instead handled exclusively in accordance with our AML/KYC Policy.

9. Website Use

9.1 Acceptable Use

You may use our website for lawful purposes only. You must not:

  • Use our website in any way that breaches any applicable law or regulation;

  • Transmit any unsolicited or unauthorised advertising or promotional material;

  • Attempt to gain unauthorised access to our website, server, or any connected system;

  • Introduce viruses, malware, or any other harmful material;

  • Scrape, copy, or harvest any content from our website without our express written permission.

We reserve the right to suspend or restrict access to our website at any time and without notice.

9.2 Accuracy of Information

We make every effort to ensure the information on our website is accurate and up to date. However, we do not guarantee that all content is error-free, complete, or current. Watch listings, prices, and availability are subject to change without notice. We are not liable for any reliance placed on information that has since changed or been corrected.

9.3 Third-Party Links

Our website may contain links to third-party websites — for example, to platforms such as Chrono24. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

10. Intellectual Property

All content on our website — including but not limited to photography, written descriptions, logos, branding, and the design and layout of the site — is owned by or licensed to Hautology Watches Ltd. and is protected by Irish and EU intellectual property law.

You may not reproduce, copy, distribute, republish, download, display, or transmit any part of our website content in any form or by any means without our prior written permission. This includes, in particular, our watch photography, which is our original commercial content.

Nothing in these Terms grants you any licence or right to use our intellectual property other than for the purpose of browsing our website and engaging with our services in the normal course.

11. Privacy & Cookies

We take your privacy seriously. Our Privacy Policy explains in full how we collect, use, store, and protect your personal data in compliance with the GDPR and the Data Protection Acts 1988–2018. It also sets out your rights as a data subject.

Our website uses cookies. Our Privacy Policy includes details of the types of cookies we use and how you can manage your preferences.

Both documents are available on our website and are incorporated into these Terms by reference. By using our website or services, you acknowledge that you have read our Privacy Policy.

12. Limitation of Liability

12.1 General

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Irish or EU law.

12.2 Watches & Items Held by Us

While a watch or other item is in our possession — whether for sale, consignment, servicing, or any other purpose — our liability for loss or damage is limited to the insured value of the item — being the agreed minimum payout (for consigned items), the agreed purchase price (for items we have agreed to buy), or the value declared for insurance purposes, such as a stated asking price, where no price has yet been agreed. We maintain insurance cover accordingly.

We strongly recommend that where the market value of an item exceeds the agreed figure, you arrange supplementary insurance at your own cost.

12.3 Website

To the extent permitted by law, we exclude all liability for any loss or damage — direct, indirect, or consequential — arising from your use of, or inability to use, our website, including any reliance on information contained on it. This includes but is not limited to loss of income, loss of profits, or loss of data.

12.4 Force Majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, civil unrest, strikes, government action, or failure of third-party infrastructure such as courier services, banking systems, or internet connectivity. We will notify you as soon as reasonably practicable and will do our best to minimise the impact.

13. Complaints

We take complaints seriously and will do our best to resolve any issue promptly and fairly. If you have a complaint about any aspect of our service, please get in touch with us directly in the first instance — by email or via the contact form on our website. We will acknowledge your complaint as quickly as possible and make every reasonable effort to resolve it to your satisfaction.

If we are unable to resolve your complaint directly, please see Section 14 for information about dispute resolution.

14. Dispute Resolution

We hope that any issue can be resolved through direct conversation. If a dispute cannot be resolved informally, the Parties agree to attempt mediation before pursuing legal proceedings. The costs of mediation will be shared equally unless otherwise agreed.

If mediation is unsuccessful or refused, either Party may bring proceedings before the appropriate court. For consumers based in the EU, nothing in these Terms affects your right to bring proceedings in the courts of the country in which you are resident, in accordance with applicable EU consumer law. For all other disputes, the courts of Ireland shall have jurisdiction.

The European Commission also provides an Online Dispute Resolution (ODR) platform for consumers, available at ec.europa.eu/consumers/odr. We are not obliged to participate in ODR but may choose to do so at our discretion.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland. For consumer transactions, any mandatory consumer protection provisions of the law of the country in which the consumer is habitually resident shall continue to apply where required by EU law, including Directive 2011/83/EU on consumer rights and Regulation (EU) 2017/2394.

16. Changes to These Terms

We reserve the right to update these Terms at any time. The current version will always be available on our website, with the “Last updated” date shown at the top. Changes take effect from the date of publication. Your continued use of our website or services after a change constitutes your acceptance of the updated Terms.

Where changes are material, we will take reasonable steps to bring them to your attention — for example, by displaying a notice on our website.

17. General

  • Severability: If any provision of these Terms is found by a court to be invalid or unenforceable, that provision shall be severed and the remaining Terms shall continue in full force and effect.

  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

  • Entire Agreement: These Terms, together with our Privacy Policy, Returns & Warranty Policy, and any signed agreement between us, constitute the entire agreement between you and Hautology Watches Ltd. in respect of your use of our services and website.

  • No Third-Party Rights: These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act or any analogous legislation in favour of any third party.
